MCWD had extended the Day 1 of the year 2 of delivery to October 1, 2016. CMWD however, had failed to fully  complete the main injection point at Casili in Consolacion and the final (i.e. approved) drop-off points in Compostela, Liloan, and Consolacion on the above date.

CMWD had requested another time extension of the Day 1 of the year 2 in order to fully complete the required main injection and 3 drop-off points. MCWD is open to grant another time extension on the condition that liquidated damages will be imposed upon CMWD if it failed to complete the required injection points within the new time extension. The parties had agreed to execute a Supplemental Agreement for the liquidated damages.

MCWD early this month had sent to CMWD for comment/concurrence a draft Supplemental Agreement that will cover the new Day 1 of the year 2 of delivery and provisions for liquidated damages. CMWD has yet to return the draft Supplemental Agreement.
